An Australian job applicant, Jacob Blatch, has lost an unfair dismissal case after mocking his future employer's business in his application email before being hired and later sacked six months into the role. Blatch applied for an appointment setter position at Perth-based Omni Digital Marketing by emailing founder Alexander Bruce directly, ridiculing the company's website, hiring process and background as a "one man orchestra playing three instruments badly" while insisting "you need me." Despite the scathing tone, Bruce hired him, but the arrangement soured amid disputes over billing and productivity, leading to Blatch's dismissal.

The Fair Work Commission ruled against Blatch, finding he had been engaged as a contractor rather than an employee, which meant unfair dismissal protections did not apply. Blatch began working remotely from Vietnam and the Philippines for Omni in July last year, earning $35 an hour, before being let go in December after Bruce raised concerns about unnecessary billed hours and low productivity, including monitoring his call volumes and requesting hourly productivity ratings. Deputy President Judith Wright cited a recorded Zoom call in which Blatch himself described his position as that of a contractor, which proved decisive in the Commission siding with Omni.
