The memo drew fresh attention when it was linked to Instagram posts by WPLG anchor and reporter Jenise Fernandez, in which she appeared in a bikini during a holiday, prompting speculation over whether such content breached the station's policy.

Fernandez, who has worked at WPLG since 2014 and is a former Miss Miami, shared photographs from a trip to Fiji with her roughly 28,000 followers, including images of her in a red bikini aboard a resort boat and at a floating bar. According to reporting by FTVLive, Pohovey had written that he had raised the issue "numerous times" before. However, the memo was reportedly sent weeks earlier, before Fernandez's latest posts, and Pohovey disputed suggestions that it was circulated in response to them in a statement to the New York Post.
