A Massachusetts father, Luis Rivera, has filed a federal Title IX complaint against the Old Rochester Regional School District after alleging his nine-year-old daughter was subjected to sex-based harassment when a transgender classmate entered her bathroom stall. Rivera, whose daughter attends Rochester Memorial School, has hired attorney Sam Whiting and continued campaigning at school committee meetings for a change to the district's bathroom policy, while he and his wife have withdrawn their daughter from the school for the coming year.

The complaint, filed in May, also alleges the transgender student had previously watched girls using the bathroom, which Rivera and his attorney say breached their privacy. The district says an independent decision-maker found staff acted in compliance with Massachusetts law, which protects students' gender identity and requires access to facilities matching it; Superintendent Michael Nelson said the district has no plans to change its policy and noted staff have faced threatening messages over the dispute. Rivera's daughter has also written to President Trump and the first lady describing feeling scared to use the girls' bathroom.
