Disney’s ABC tells FCC that The View qualifies for news exemption

Disney's ABC has filed a formal submission with the US Federal Communications Commission (FCC) arguing that its daytime talk show "The View" qualifies for the same "news exemption" as traditional programmes such as "World News Tonight" and "Good Morning America". The move matters because it is a direct response to what Disney characterises as improper political pressure from the Trump administration, and it tests whether the government can exert influence over the editorial content of broadcasters. ABC contends that "The First Amendment does not permit the government to sit in an editor's chair."

The dispute stems from the FCC, under Chairman Brendan Carr, ordering Disney to file renewal applications for eight of its stations years ahead of schedule — a demand Disney made "under protest", calling it "unlawful, arbitrary, and unconstitutional". The FCC has also probed whether "The View" breached "equal-time" election rules after Texas Democratic Senate candidate James Talarico appeared in February, following January guidance requiring daytime and late-night hosts to give equal time to candidates from different parties. After ABC urged viewers to comment, more than 76,000 public submissions were filed, alongside roughly 50 organisations including the ACLU, FIRE and TechFreedom, which want the FCC to reaffirm the 2002 Declaratory Ruling recognising the show as a bona fide news interview programme.
