A federal judge has rejected Minnesota’s emergency attempt to keep ICE agent Christian Castro in a Texas jail while Governor Greg Abbott considers an extradition request. The ruling means Castro could be released when his 90-day detention period expires, unless Abbott signs a rendition warrant or another court order is issued; Minnesota says his potential departure could jeopardise its assault case.

Minnesota requested Castro’s extradition in early June after he was charged over a January ICE operation in which he allegedly fired through a home’s closed front door, injuring someone in the leg. The state cited jail calls suggesting Castro had discussed a future move to Mexico, but the judge ruled the case was premature because Abbott has neither approved nor refused extradition and faces no specified legal deadline to decide. The case forms part of wider disputes between Minnesota authorities, Texas and the Trump administration over prosecutions of ICE agents.
