Metal band Demon Hunter sues Netflix and AEG over ‘KPop Demon Hunters’

The US metal band Demon Hunter, active for around 25 years, has filed a trademark lawsuit against Netflix, Netflix Studios and concert promoter AEG Presents over the title of the hit animated film "KPop Demon Hunters". The band's corporate entity, Hyde Lane, Inc., argues that Netflix has no more right to the name than it would to launch acts called "KPop Metallica" or "KPop U2", and says the dispute escalated after Netflix and AEG announced a global concert tour tied to the film. Sony Pictures Animation, which made the film, is not named as a defendant.

The complaint, filed on 18 August in the US District Court for the Central District of California, alleges trademark infringement, false designation of origin and unfair competition, seeking treble damages, restitution, Netflix's profits and a jury trial, though no specific damages figure is stated. As evidence of consumer confusion, the filing cites a parent who spent almost $500 on premium tickets to a Demon Hunter show in Albany, New York, mistakenly believing it was a KPop Demon Hunters event for their young daughters. The proposed film-related tour is said to span 150 cities, which the band argues represents near-total overlap with its own touring, merchandise and music business.
