In an Instagram post, the company said it believed "in the power of connection and bringing people together, not dividing them," and clarified it had no involvement in creating the game. This makes Tetris one of the few major gaming brands to push back publicly, as companies such as Nintendo and Pokémon's owners have previously only distanced themselves without threatening legal action when their branding was used similarly.

The White House's arcade games, which also referenced titles like Flappy Bird and Snake, used recognisable gaming imagery such as the Nintendo GameCube logo despite having no official ties to the brands. The Tetris Company stated it "takes copyright infringement very seriously" but did not specify what action, if any, it would take, and the "Build the Wall" game remained publicly accessible at the time of writing. Given the Trump administration's history of disregarding legal challenges and criticism, there is scepticism that any copyright claim would prompt the game's removal.
