Toddler suffered brain injuries when daycare worker fell on him, lawsuit claims

A lawsuit filed in California alleges that a toddler suffered a traumatic brain injury while in the care of a daycare facility run by The Bay Club in El Segundo. According to the complaint, a worker swung the 23-month-old boy, identified as C.K, into the air and released him, before falling on top of him when she failed to catch him. The case raises serious questions about safety and supervision at the club's childcare service.

The boy's father, Matt Kittle, 44, dropped his son off at around 8.30am on 17 March 2025. Security footage reportedly captured the worker holding the child by his hands, swinging him between her legs and throwing him roughly six feet into the air. The boy fell and struck his head on the hardwood floor before the employee landed on him. The complaint states other adults present were "aghast", the child cried "hysterically", and the father was later told only that his son had "fallen" but had "calmed down". Kittle collected his son to find him swollen and bruised.
