## Key points

- Judge says Comey’s firing was unlawful.
- She is to be reinstated retroactively.
- Back pay runs until her private-sector job began.

## Summary

A federal judge has ruled that the Justice Department acted unlawfully when it fired Maurene Comey, and ordered her retroactive reinstatement and back pay. The decision matters because it found the administration lacked statutory authority to remove a career prosecutor and breached civil service protections.

Comey was dismissed in July after about a decade as an assistant US attorney in New York, where she worked on cases involving Jeffrey Epstein, Sean “Diddy” Combs and former senator Robert Menendez. Judge Jesse Furman said the Civil Service Reform Act limited the grounds for her removal; back pay is due from her firing until 20 December 2025, when she took a private-sector job. It is unclear whether she plans to return to the Justice Department.
