A retired Massachusetts judge says that, if Lindsay Clancy is found not criminally responsible by reason of insanity for the deaths of her three children, she could be placed in a secure mental-health facility rather than imprisoned. Her detention would depend on whether she continued to meet the legal threshold for civil commitment, meaning the length of any hospitalisation could range from months to many years or potentially indefinitely.

The judge could initially order a 40-day locked-unit assessment, followed by a hearing that could result in a six-month commitment if Clancy were considered likely to cause serious harm. Her case would then be reviewed annually, and a facility superintendent could recommend discharge, subject to court input from prosecutors and defence lawyers. Jurors began deliberations after hearing charges of three counts of murder over the deaths of Cora, 5, Dawson, 3, and eight-month-old Callan; Clancy’s paralysis after an attempted suicide would not necessarily determine assessments of future risk.
