The US Postal Service's final rule at the centre of the row explicitly exempts ballots covered by the Uniformed and Overseas Citizens Absentee Voting Act (UOCAVA) from its new requirements, meaning military and overseas voters are unaffected. The claim matters because it was repeated on a national broadcast and amplified online, prompting a formal on-air correction and public pushback from critics who accused Spanberger of misleading voters.

Spanberger made the assertion on X on 29 August and repeated it in a CNN interview with Wolf Blitzer, who had suggested Virginia-based military personnel could be affected; CNN later issued an on-air correction confirming UOCAVA ballots are exempt, and a community note was appended to Spanberger's post citing the exemption. Republican Senator Mike Lee also disputed her claim, saying Trump had repeatedly assured him he did not intend to interfere with overseas military voting. The dispute comes after a federal judge temporarily stayed parts of the USPS rule on Thursday, and follows a Supreme Court ruling in August that gave Trump a procedural win by staying an earlier injunction, without settling the underlying legality of the policy.
