The Trump administration is asking the US Supreme Court to review whether some non-citizens with criminal convictions can obtain bond hearings during lengthy deportation proceedings. The case could affect the government’s ability to detain people while their removal cases continue, while opponents argue that prolonged detention should require an assessment of whether someone poses a flight or public-safety risk.

The case concerns a 62-year-old Dominican citizen with four convictions, including drug offences, using false identification, criminal obstruction of breathing and criminal contempt. After completing a state sentence in September 2025, he was detained by Immigration and Customs Enforcement; a lower court ordered a bond hearing under Second Circuit precedent, though it did not order his release. The administration is seeking Supreme Court intervention before the appeals court issues its ruling, after related cases became moot when the detainees left the US or their circumstances changed.
