The mothers of two boys killed by an Amtrak train in Pennsylvania in 2023 have filed a legal malpractice suit against their former lawyers, claiming they mishandled the wrongful death case against Amtrak. Jahaad Atkinson, nine, and Ah'Yir Womack, twelve, were struck by an Acela train whilst walking on railroad tracks in Chester after passing through a gap in a fence on 29 April 2023. Their mothers' original lawsuit against Amtrak was dismissed in March 2024, but Siani Gordon and Wydeia Kimble now allege their attorneys failed to present crucial evidence of Amtrak's alleged "wanton and reckless" conduct that could have resulted in a successful claim.

The mothers claim their former lawyers, Emeka Igwe and Daniel Purtell, possessed evidence—including Amtrak Police radio discussions about someone on the tracks—demonstrating the company knew about the dangerous fence opening yet failed to maintain it properly. The original suit focused on a hole in the fencing that Amtrak had erected, but Judge Mitchell S Goldberg dismissed it, ruling that railroad companies have no legal duty to fence their property. The case was transferred to Purtell's firm in April 2025 after Igwe was deployed to Kuwait with the Delaware National Guard, with court filings subsequently alleging Igwe showed "lack of diligence" and failed to conduct depositions or serve written discovery on Amtrak.
