Texas Republican seeks removal of billboard resembling his campaign ads
Republican Eric Flores has demanded the removal of a billboard in Texas’s 34th Congressional District that shows him with Donald Trump and highlights Trump’s endorsement and support for ICE. Flores says its resemblance to his campaign materials could mislead voters into thinking his team authorised it, making the dispute a question of campaign branding and voter clarity.
His lawyer sent Lamar Advertising a cease-and-desist letter on 12 October, but the billboard was still standing on 16 October. The display names Democratic Representative Vicente Gonzalez’s campaign and Northern Cameron County Democrats as sponsors. Flores, a former federal prosecutor, has also reduced the prominence of Trump references on his website since winning the Republican nomination; an estimate published on 15 October put Gonzalez three points ahead.
- Flores wants a Trump-endorsed billboard removed.
- He says it closely imitates his campaign branding.
- The billboard remained up four days after his letter.
Both sides, in good faith
The strongest fair case each way — we don't pick a winner.
The case for
Flores can argue that campaign imagery is closely associated with a candidate and that a billboard deliberately echoing his materials could leave voters unsure who authorised it. Clear attribution helps voters assess political messages and protects a campaign’s ability to distinguish its own communications from those of opponents.
The case against
The billboard identifies Gonzalez’s campaign and local Democrats as its sponsors, giving viewers information about who is responsible for the message. Political opponents can reasonably use a candidate’s public association with Trump and ICE to criticise him, and a resemblance to campaign advertising alone may not justify removing a clearly attributed political display.
