The incident involved a three-wheeled sports car overturning at the broadcaster's test facility, resulting in severe injuries to Flintoff. The driver's participation in the accident had not been publicly disclosed until the lawsuit came to light.

BBC Studios contests the claim and alleges the passenger's instructions were responsible for the crash, noting that the passenger made no injury reports immediately after or in subsequent communications. According to court filings, the passenger advised Flintoff to apply maximum acceleration before the vehicle overturned. Flintoff, who was a Top Gear co-host at the time, previously reached a separate settlement with the BBC in 2023 for his own injuries from the incident.
