A New Jersey school district, the School District of the Chathams, is being sued over a policy that allows students to change their name and gender identity at school without notifying their parents, with a guidance counsellor deciding how much parents are told. The lawsuit, brought by the Thomas More Society on behalf of Moms for Liberty, Moms for America and two anonymous parents, argues the policy defies the US Supreme Court's ruling in Mirabelli v. Bonta, which found parents have legal standing to challenge such confidentiality policies regardless of whether their own child is transitioning.

The policy permits students to use bathrooms and locker rooms matching their gender identity and allows changes to official school records, while a code of conduct provision could reportedly see pupils disciplined, including suspension, for using an incorrect name or pronoun for a classmate. Filed on 24 August, the suit alleges violations of First Amendment and 14th Amendment rights and cites the Mahmoud v. Taylor ruling on parents' rights to opt children out of LGBT-related lessons. It follows a June 2026 school board meeting at which the board president said the district was bound by New Jersey's 2018 state guidance rather than the Supreme Court decision; the school district has not yet responded to requests for comment.
