Five-star hotel employee who was told to complete the payroll in a cupboard ‘after she struggled to focus in the office’ wins more than £200,000
Roberta Ghiotto, a Talent and Culture Coordinator at the five-star Hawkwell House Hotel in Iffley, Oxford, has won more than £200,000 in compensation after an employment tribunal found she was unfairly dismissed because of her ADHD. Ms Ghiotto had disclosed to general manager Anuj Sagar that she struggled with detail-heavy tasks and focusing in a busy office, but instead of receiving support she was later sacked, with the tribunal ruling this amounted to disability discrimination under the Equality Act.
Ms Ghiotto, employed from October 2023 to March 2024, was tasked with completing the hotel's payroll and was placed on an extended probation after making errors. In February 2024, Mr Sagar had her work alone for three days in a windowless former cupboard to complete payroll duties, which the tribunal found was designed to make her fail. After she disclosed her undiagnosed ADHD, Mr Sagar sought advice from consultancy firm Croner and was told he could dismiss her because she lacked a formal diagnosis; Employment Judge Akua Reindorf KC ruled this belief was mistaken and that Ms Ghiotto was nonetheless protected, awarding her £200,252 after she described falling into depression following her dismissal.
