Newark HelloFresh workers allege discrimination and restricted toilet breaks in lawsuit
Workers at a HelloFresh facility in Newark, New Jersey, allege they faced abuse, discrimination and restrictions on bathroom breaks, according to an amended complaint in a proposed class action. The claims, which HelloFresh denies, matter because they raise questions about treatment of temporary workers and compliance with state anti-discrimination laws.
The lawsuit, first filed in August 2024, names HelloFresh and staffing agencies Action Staffing, On Target Staffing and ProStaff Workforce Solutions. Workers allege Hispanic staff were assigned harder duties, harassed for speaking Spanish and monitored more closely than non-Hispanic colleagues; one former worker says restricted bathroom access led to incontinence and infections. A judge is due to review the amended complaint on 23 October, while HelloFresh says an internal investigation found the allegations without merit.
