It was lawyer mom’s fault that daughter, 5, fell off Disney cruise ship into ocean… now listen to moment she told cops to charge entertainment giant with child abuse while deputy secretly condemned her

Daily Mail ·

A five-year-old girl fell 49 feet from a Disney cruise ship into the Atlantic after her mother, Michelle Sapp, asked her to pose on a porthole ledge. Her father jumped in about 45 seconds later and kept them both afloat until the crew rescued them; the incident prompted a child abuse and neglect investigation.

In audio of a police interview, Sapp argued that Disney should be held responsible because she believed the porthole was covered and said the ship’s design endangered children. Her husband suffered hypothermia, two spinal fractures and lactic acidosis, while the child had minor injuries. Prosecutors considered a neglect charge against Sapp, but the criminal case was ultimately dropped.

Both sides, in good faith

The strongest fair case each way — we don't pick a winner.

The case for

Sapp’s strongest case is that she believed the porthole was covered and that a passenger area should not expose a child to a fatal fall through an opening she did not recognise as dangerous. The ship’s design and safety measures therefore merit scrutiny, especially where children are present, and responsibility need not rest solely with a parent.

The case against

The strongest case against Sapp is that asking a five-year-old to pose on a porthole ledge created an obvious risk, and a parent has a particular duty to keep a young child away from dangerous heights. Even if she misunderstood the porthole’s condition, that does not remove the concern that closer supervision could have prevented the fall.
