Joshua Gibbons is suing Kingsport, Tennessee, police after officers raided his home and arrested him shortly after he filmed and criticised an officer for allegedly speeding without lights or sirens. The lawsuit, supported by the Foundation for Individual Rights and Expression, claims the arrest was retaliation for protected speech and online criticism, and says the raid violated his First Amendment rights.

In October 2022, an arrest warrant was issued within two hours of police learning about Gibbons’ video, alleging speeding, mobile-phone use while driving and disorderly conduct. Eight armed officers arrested him before dawn in front of his family; after two trials, Tennessee’s Court of Criminal Appeals unanimously overturned his disorderly-conduct conviction and dismissed the charge, finding no evidence that his criticism obstructed lawful activity. FIRE says Gibbons is seeking reforms and accountability from the department.
