Trump admin cannot refuse detained illegal immigrants a chance for release on bond, appeals court rules

Fox News · 2 hours ago

A federal appeals court has ruled that the Trump administration cannot automatically deny detained migrants within the United States an opportunity to seek release on bond. The decision blocks part of the administration’s expanded mandatory-detention policy and could affect how immigration authorities handle custody decisions while cases proceed.

The Ninth Circuit Court of Appeals in San Francisco issued the ruling on Thursday by a 2–1 majority. It held that migrants detained inside the country must be given a chance to request bond, rather than being subject to blanket mandatory detention under the policy.
