New York subway antisemitism case delayed as defendant seeks new lawyer

Daily Mail ·

Christopher Husary appeared in Manhattan criminal court over charges that he threatened and harassed a Jewish man with antisemitic abuse on a New York subway in June 2024. The hearing, which was due to determine whether the case would go to trial, was postponed after the judge said his lawyer could no longer represent him for medical reasons.

Husary has pleaded not guilty to attempted coercion as a hate crime and aggravated harassment. He was previously sentenced in California to 364 days in jail and two years’ probation after pleading guilty to robbery with a hate-crime enhancement over an incident in which he pushed a woman at a pro-Israel demonstration and burned her Israeli flag. His New York hearing was rescheduled for 10 November so his new lawyer could review the evidence.

  • New York court postponed Husary’s hearing until 10 November.
  • He denies subway-related hate-crime charges.
  • He was previously sentenced over an incident in California.

New York’s subway system carries millions of passengers, and incidents involving threats or harassment can lead to criminal charges. In this case, prosecutors accuse Christopher Husary of threatening and harassing a Jewish passenger with antisemitic abuse on a train in June 2024.

Husary has pleaded not guilty to attempted coercion charged as a hate crime, and aggravated harassment. A hate-crime designation means prosecutors allege that bias, such as hostility towards a person’s religion, was connected to the alleged offence; the charges are not findings of guilt.

Husary has also faced a separate case in California, where he pleaded guilty to robbery with a hate-crime enhancement and was sentenced to jail and probation. The New York case matters because a court must decide whether the evidence supports proceeding to trial, while the California case is separate.
