Anti-fire ant eradication activist convicted after using legal arguments ‘similar to sovereign citizens’
Trevor Hold, who leads a group opposing Australia’s fire ant eradication programme, was convicted of obstructing government officers after trying to stop them treating his property in Queensland. A magistrate rejected his arguments that the programme was unlawful and that he had a reasonable excuse to refuse access; the case is believed to be the first of its kind in Queensland.
Hold was fined A$1,500, but no conviction was recorded, and he has appealed to the District Court. Queensland’s Biosecurity Act requires landholders to allow programme officers onto their properties to treat declared priority pests. A legal expert compared parts of Hold’s defence, including notices he sent to government departments, with arguments used by sovereign citizen groups.
In short
- Hold was fined A$1,500 for obstructing fire ant treatment officers.
- The magistrate rejected his arguments that the programme was unlawful.
- He has appealed the ruling to the District Court.
Steelman: both sides, in good faith
The strongest fair case each way — we don't pick a winner.
The case for
Compulsory access gives authorities a practical way to contain fire ants, which can spread across property boundaries and threaten ecosystems, agriculture and public safety. Requiring landholders to permit treatment may be justified where voluntary cooperation would leave gaps in a region-wide eradication effort, provided the powers are lawful and applied proportionately.
The case against
Landholders have a legitimate interest in control over their property and in scrutinising government action, especially where treatment is imposed without their agreement. They may reasonably argue that access powers need clear legal authority, transparent safeguards and a fair way to challenge decisions; Hold’s appeal could test whether those protections were properly applied in his case.
