‘An insult to his culture’: Italian chef fired after refusing to put pineapple on pizza, loses case in Australia
Italian chef Davide Tamburella lost his challenge over his dismissal from a Brisbane restaurant after refusing to make ham-and-pineapple pizzas, which he regarded as an insult to his culture. The case drew attention because the disputed topping was one of several complaints about his conduct, while his dismissal also disrupted his attempt to secure Australian permanent residency.
The Fair Work Commission rejected his application because he filed it outside the statutory 21-day limit and did not show exceptional circumstances for an extension. It therefore did not decide whether his dismissal breached the Fair Work Act or whether refusing the pizzas justified dismissal. Tamburella had refused similar instructions about three times over four years; the restaurant also cited concerns about his communication and behaviour, while he argued his dismissal was partly linked to a workplace injury.
In short
- Chef’s pizza refusal featured among several complaints behind his dismissal.
- The commission rejected his case as late.
- It did not rule on whether the dismissal was lawful.
