New Mexico’s Supreme Court has ruled that hospital video showing Alexee Trevizo speaking after her newborn son was found dead cannot be used at her murder trial. The decision preserves patient confidentiality and significantly limits the prosecution’s evidence in a case that has drawn national attention, while Trevizo remains presumed innocent.

Trevizo, who was 19 at the time, is charged with first-degree murder and tampering with evidence after the baby was found in a bin at Artesia General Hospital in January 2023. The court found that her statements to medical staff and footage recorded during treatment were protected by doctor-patient privilege; the case will now return to the lower court to determine how it proceeds without that material.
